Victory for Justice: Afe Babalola’s Decision to Withdraw Suit Against Dele Farotimi is a Step Toward Strengthening Democracy

The League for Social Justice commends the decision by Senior Advocate of Nigeria and elder statesman, Chief Afe Babalola, to withdraw the criminal defamation suit against human rights lawyer Dele Farotimi. This action reflects wisdom, reconciliation, and a commitment to safeguarding the principles of democracy and free expression in Nigeria.

Dele Farotimi’s book, Nigeria and its Criminal Justice System, sought to ignite meaningful discourse on critical issues affecting our nation. While disagreements on perspectives are inevitable, the criminalization of dissent undermines democracy and threatens the public’s right to hold power to account.

We recognize and deeply appreciate the efforts of the Ooni of Ife, Adeyeye Ogunwusi, alongside other esteemed Yoruba traditional rulers, in facilitating this resolution. Their intervention underscores the power of dialogue, unity, and collective leadership in addressing challenges and fostering understanding.

We also acknowledge Chief Afe Babalola’s humility and statesmanship in heeding calls from eminent Nigerians, including former President Olusegun Obasanjo and Bishop Hassan Kukah, to de-escalate the matter. This decision sends a powerful message about prioritizing the national interest over personal grievances.

Broader Implications

While this resolution is welcome, the League for Social Justice reiterates the urgent need to reform Nigeria’s defamation laws. Criminal defamation is an outdated legal mechanism that stifles free speech and is prone to abuse. We call on policymakers and stakeholders to decriminalize defamation and adopt legal frameworks that prioritize civil remedies in line with global democratic standards.

A Call to Action

This moment is an opportunity to recommit to protecting the freedoms enshrined in our constitution. We urge:

  1. The judiciary and law enforcement agencies to remain impartial and resist being weaponized against dissent.

  2. Public figures to embrace dialogue and civil engagement as the primary tools for addressing grievances.

  3. All Nigerians to support and amplify efforts to strengthen our democracy, ensuring that free speech is not only protected but celebrated.

The League for Social Justice remains resolute in its mission to defend democracy, promote accountability, and protect the rights of every Nigerian. Let this be a turning point toward a society where ideas are debated, not silenced.

Signed:
